Mayor Jerome Prince pleads GUILTY to fraud.
He stole funds. He did it with full knowledge that it was illegal. He is a thief. He is a felon. Now Prince is requesting that he be sentenced to one year of probation without any conditions of confinement or home detention so that he will not have to be subject to incarceration. Interesting. So Prince was caught (he did not turn himself in due to a guilty conscience), then, since he couldn't get out of it, he tries to enter a plea deal so that he can still have an easy path ahead.
Do you believe this is the only illegal act Prince has committed? Are others associated with his illegal actions?
Prince was in office when former Gary Indiana city attorney, Rodney Pol, incorrectly and illegally wrote a letter stating that the owners of 6619 Forest Ave have a 'right to build.' The law says otherwise. Rodney Pol (see below) was found to be no longer a city attorney with Gary City Hall, after the City of Gary was sued for unlawful activity regarding actions involving 6619 Forest Avenue, which occurred around August 2024. Interesting timing, don't you agree?
Even more compelling, around the same time Rodney Pol wrote that letter in 2023, Jerome Prince's corporation council (attorney) Angela Lockett was fired by Prince for refusing Prince's request to do something "unethical and illegal." Did Ms. Lockett stand her moral ground, stand for the law, where Rodney Pol did not? Whatever the case may be, something is rotten in the city of Gary Indiana.
Wait there's more! Believe it or not, also around the same time, executive director of redevelopment, Wendy Vachet, was fired by Prince. No reason given by the one who swore to protect the people of Gary Indiana. Now, mind you, Prince fired these folks when he only had a few months left in his term before the mayor elect would be replacing him. This isn't the time to be restructuring. Odd, isn't it? Prince refused to provide accurate reasons for these firings.
Rodney Pol is no longer with the City of Gary as their city attorney. This occurred after we filed a legal petition in response to the debauched Board of Zoning Appeals Hearing of our case on June 13, 2024. Rodney Pol ran the hearing that day. He did not follow the legal process and provided incorrect information regarding our case, 6619 Forest.
Fraud, Unlawful behavior is allowable in the City of Gary Indiana
Just ask the COO.
A very sad day for the city of Gary Indiana.
What occurred at the June 13 2024 Board of Zoning Appeals Hearing was nothing less than theatre of the absurd.
Corruption is not only taking place, it was displayed openly at the hearing. As the happenings that ensued buzz in my head, I ask myself "Did that really occur or was it a bad dream?" No it really happened.
When asked after the hearing commenced about the unlawful actions and the lack of procedural due process, Michael Suggs, the Chief Operating Officer for the City of Gary shrugged his shoulders expressing "Oh well." Other questions were posed to him and he often deflected. What about accountability [Michael Suggs]? "What accountability, they ruled" he responded. What accountability!? From the COO of the city!? It has been apparent the city has many issues but those of us (residents attending) at the hearing didn't believe it was this bad. Perhaps the most pronounced aspect of this event was the shameless behavior of all the government representatives who mishandled the event: an event that has a major impact on people's lives.
After speaking about it with a few who were present at the hearing, the best we could come up with was, "Well, they've probably been doing things this way for so long, for them, it is a normal course of action." This essentially means being dishonest and immoral is acceptable. Taking a step back, it is very disheartening to see. The law doesn't matter. Humanitarianism doesn't matter. How does a city hall become so malicious, so defective?
A few items of note regarding the hearing:
The board members appeared (in speech and body language) as though they had been influenced -to pass- the variance before the hearing started.
City attorney, Rodney Pol, stated inaccurate information to the board regarding the situation (which supported the approval position). It appeared he did this to give an appearance of legitimacy.
The board usually follows the advice of the zoning speaker/administrator. The zoning administrator stated the Harrises' information submitted was incomplete, and he recommended that the request be 'continued' until the next hearing. In this case the board did not. Three out of four quickly approved the request without any recognition of over 50 residents who signed a petition against the variance, or the citizens who spoke at the hearing in person citing many legal reasons why the request should be rejected. The lawful process the board is expected to follow was disregarded. The one board member who voted against it (which holds no weight as 3 votes out of four easily wins) appeared to do so only to give the appearance of objectivity. But if you witnessed his behavior during the hearing as a whole, you would most likely feel that this individual was very biased while playing his part in this very absurdist piece of theatre. If the city wants to play kangaroo court, have the foresight to hire some decent actors.
What comes into view is a city that, unfortunately, is being sold out. Until people organize and go to all the various governance meetings to monitor and adjudicate , this nonsense will continue.
I know, it can be 'uncomfortable' to stand up and speak out. It is more comfortable to watch a movie or go out to a restaurant.
Be willing to be uncomfortable. Be comfortable being uncomfortable.
You may have heard that quote many, many times. And it remains true.
The city is aware that no one cares. Dishonest and illegal behavior will continue as taxpayers foot the bill. Do you care? If I may say, in my humble opinion, you should.
If the above is unfamiliar, read 'The Story' below.
All of the following can be proven.
The Story
1. A small empty lot, 6619-23 Forest Ave Gary, IN 46403, was listed for sale.
No problem with that, anyone is allowed to sell their property.
2. The PROBLEM
a. By law, the lot, at 40 feet wide, is too narrow to build on. It must be 59 feet wide (R1 Zoning Law).
b. Since it is very narrow, a house built on that lot will be VERY close to our house, at 6615 Forest Ave. We don't want a house built so close to our house. Zoning law exists to protect residents. We knew the small lot next to our house was unbuildable by law. That was part of the reason we purchased our house.
c. We would have bought the lot ourselves when it became available, but it was extremely overpriced. At that inflated price, the lot would only sell if a buyer believed they could build a house on it. That is exactly what happened.
3. Hiding, concealing to get their way.
The lot was pending for seven months. We believe it took long to close due to the buyer and Gene Ayers maneuvering to get around the law. The buyer, after 7 months, apparently received a letter from someone at city hall that gave him assurances to build, then the deal closed.
a. Real estate agents, by their license, are not allowed to market (convey, indicate, etc) to potential buyers that the lot CAN be built on. Doing so is misrepresenting a property, and thus, malpractice. Gene Ayers did misrepresent the property and found an out of state buyer that purchased it with the intention to build.
b. We were very surprised and disappointed with Gene's behavior. Beyond the above, he has refused to communicate with us. As a result, we began to get the word out and spoke to other neighbors. We posted signs. We started this website. We presented the illegality of this situation to city hall.
c. After we started getting the word out, by exercising free speech, Gene Ayers hired a lawyer to harass and intimidate us by phone and mail. A low path to take, to say the least. He was the one who refused to communicate with us. Apparently he preferred to bully instead of communicating with us in a civil manner; he evidently believed he could dominate us by using scare tactics. Gene is important, but we are not. We became more surprised and disappointed with his behavior.
It is possible Gene Ayers will be prosecuted for malpractice and breach of duty. His attorney, who harassed us, may also be prosecuted. Movement to revoke his law license may be part of this effort. It is illegal for an attorney to harass on behalf of a client.
4. There is a variance hearing scheduled
for Thursday June 13, 3pm Gary City Hall 2nd Floor. A variance is an exception given by the city - in this matter it would give the new owner permission to build on the lot even though the zoning law states the lot is unbuildable. The new owner wants to build on the lot. Since we have been expressing our opposition and pushing back, the city told him he must get a variance by going through the hearing process. The new owner has scheduled a variance hearing to get permission. We will be there, to again express our opposition and ask the city to enforce its zoning law. If you would like to be there we would appreciate your support.
Overall we feel:
The neighborhood should know what is occurring.
Unethical behavior, especially for personal gain, needs to stop in our community.
Exploitation of residents here in Miller must end.
The City of Gary should defend its zoning law and reject any efforts to build on this lot.
Everything we are working towards is in line with the statements and posted goals of mayor, Eddie Melton. Based on our experience, Eddie Melton's statements are a fig leaf, masking continued corruption.
These issues apply to all of us living here in Gary Indiana. Contact us to make a difference.
Injustice anywhere is a threat to justice everywhere.
If a variance hearing is ensuing (which it is), the lot was unbuildable from the start. Otherwise there would be no need for a variance.
Yet, it was marketed as 'buildable' by Gene Ayers, Realtor.
Unethical: Yes
Fraud: It sure looks like it
Support your neighbors, support yourself by standing up to the many unlawful practices occurring at city hall.

The variance hearing was held on June 13, 2024 at 3pm.
In short, the processes were unlawful. The city attorney Rodney Pol and COO Michael Suggs sanctioned the fraudulent behavior that took place that day. A woeful exhibition of the inner workings of Gary Indiana City Hall.
From the surface this sign appears to indicate a proper city process taking place. Sadly, it turned out to be a 'pretend' BZA Hearing - something out of a bad surreal movie about a lawless city.
The math is quite clear
The politics are not
Gene Ayers and Nancy Del Prado, of Ayers Realtors, have marketed 6619-23 Forest Ave 46403 as a buildable lot. It is not.
The lot is 40 ft. wide. It must be 59 ft. wide in order to build in R-1 zoned areas.
Selling this lot with the buildable attribute is unethical & illegal. It is misrepresentation. Gene Ayers refuses to communicate with us.
Ayers Realtors found an out of state buyer. This buyer intends to build on it.
News:
Gene Ayers attended the Shirley Heinz Land Trust 2024 Spring Benefit on May 4 in Valparaiso. They are a conservation organization protecting habitats and ecosystems in Northwest Indiana . We can't help but see this as hypocritical. When it comes to his wallet he doesn't care the least about conservation and preserving land as in the 6619 lot where much wildlife calls home. But he evidently likes to appear in public as if he cares about such endeavors.
----------
Gene Ayers of Ayers Realtors - investigated by the State of Indiana Attorney General for Malpractice and Breach of Duty.
----------
6619 Forest Ave has been sold by Gene Ayers: January 2024. It took 7 months to close. Why would an empty lot take 7 months to close? Were they trying to get around the law?
----------
The buyer of the lot was contacted. He has been unwilling to have an honest discussion regarding the situation. We have informed him that building on this lot is not permitted by zoning ordinances. Both the buyer and Gene Ayers have yet to provide any legal documentation. This includes the so-called BZA Hearing. The Harrises, attorney Rebecca Wyatt, and Gene Ayers provided no required legal documentation regarding building on this vacant lot.
----------
Documentation was furnished to City Hall validating the illegality of Gene Ayers' actions and any plans to build on the lot.
----------
Nancy Del Prado has since relinquished her partnership with Gene Ayers.
----------
City hall has been experiencing obstacles for some time now. It is our hope the new mayor will find a way to remedy the many obstacles before him. It appears Gene Ayers and others may have taken advantage of the disarray to benefit themselves in the past. It is our hope this type of maneuvering will remain in the past.
When the law
is not upheld
Why BULLY? Because I can!

The Realtor choose to bully instead of civil conversation
This article will look into why some people choose to bully others instead of using civility, respect, adult conduct to resolve conflict.
The idea of a bully often conjures up an image of a kid purposely being mean to another kid. We might pardon such actions because, well, s/he is just a kid. When adults choose to bully, it is an especially sad situation due to the fact that, well, s/he is an adult.
Threatening, harassing phone calls are, indeed, acts of bullying. This, unfortunately, happened to us regarding the 'vacant lot situation' and it appears the Realtor, Gene Ayers, was behind it. Bullying is the repeated infliction of harm or distress on another person with the intent to control, intimidate, or otherwise damage another.
One neighbor who is supporting this cause told us about a call received where a man, who refused to identify himself by his real name, but instead stated that he was a lawyer, then proceeded to interrogate: Why are you saying bad things about Gene?! Hmmm, not too hard to figure out the math on this. 1. We are supposed to be afraid of lawyers. 2. Since you are now afraid of me, you better stop doing what you are doing! Subsequently my wife and I received an unusual high number of phone calls from unfamiliar phone numbers. We didn't answer those calls as we guessed the intent (to bully). There was no voicemail left, or should we say there was no evidence left in the form of a voicemail. The team at Ayer's Realtors or perhaps just Gene himself made a distinct decision to bully us, but did not want to be accountable for such actions. He did not want the community (that sustains their business) to know he was doing this. Well, he was doing this.
This is a grown man who has been doing business in Miller Beach for years. Why would he behave this way? Why choose to bully, when there are many more effective and civil pathways?
I’m attempting to envision what it was like in ‘caveman’ times. There is only one squirrel left on the dinner table. The two alpha males reach for it at the same time. Uh oh, we have conflict. They can’t speak yet so they grunt and try to look tough and then they attack each other… until the death of one or both.
Okay, their linguistic skills were limited and the paradigm back then was more survival of the fittest.
Then as we move along in time,
we go from neanderthal to homosapien and with it our communication skills improve: “So sorry, how about we split that last squirrel instead of killing each other for it?” "Ah, splendid idea!" Unfortunately, using spoken language still competes with brutal force: guns, bombs… things that kill humans.
Is bullying about anger? Anger, as the experts say, leads us to poor decision making and generally regrettable positions. There are other paths to choose. Wiser pathways.
From my previous article (now integrated into this article), I wrote about what the experts say regarding bullying:
1When researching this phenomenon called bullying, I found a few explanations. Many who study the human condition and psychological aspects of behavior say it is a control issue. There are some of us who have strong desires to control and thus, make bad decisions in life. You better do what I tell or I’m gonna, well, you better listen to me or else!
Here are more reasons from the experts:
They have emotional trauma. Hurt people, hurt people. They lack the coping skills to handle their pain so they externalize their pain on others.
They are insecure. Bullying apparently makes them feel superior.
It’s a learned behavior. A child may have been the victim of bullying by a parent.
Bullying can become a toxic part of the culture at work or in other social communities and is ultimately accepted as the norm. Perhaps a certain sector of humanity truly accepts bullying as a societal norm. That’s the way the world works!
They have poor social skills. One who has a hard time getting along with others. From this, they may be resentful or jealous of the person they’re targeting.
They lack empathy. They lack the ability to care for/about others. They are okay with dominating, blaming, intimidating, or taking advantage of others. There is a lack of understanding how their terrible behavior negatively impacts people. They are driven by a desire for power and attention. They have not learned to be kind, compassionate, or respectful.
A common thread in all of my research on this topic is closely connected to this statement: Bullying is about them and their internal trauma.
Now, let’s look at what the experts recommend as ways to respond to a bully.
Acknowledge the behavior is unacceptable
Mr Realtor (Gene Ayers), your behavior is not right, it is unacceptable, I will not stand for it. Ah, I’m feeling better already. Have you no manners? Where is your etiquette? Okay, okay, that’s enough.
Don’t bully back
That’s it, Uncle Louie is going to pay you a visit! Wait, stop, no. Fighting back isn't going to help. This isn’t monkey see monkey do. I had a few thoughts, but no, no fighting fire with fire. We are supposed to be evolving as a species, improving ourselves.
Tell someone
This was intuitive. I did. I am. No embellishments. It doesn’t need embellishing as what has, and is occurring contains all the attributes of drama.
Hold them accountable
Well this is one way to hold him accountable. Publish it! Well, partner, now, you listen to me here, see: Your actions are wrong, unethical, and we believe, illegal. It is my guess that you may have thought you could get your lawyer friend to make phone calls on your behalf in order to intimidate, harass, control, or distress us (us being neighbors who have done nothing wrong, we just stood up to you). It is also my guess you thought you could ‘get away’ with this type of behavior without anyone in the community knowing about it. Strangely though, it wasn’t just me you were calling. You called / harassed several folks in the community. You didn’t think that would get around?
Recognize that the bullying isn’t about you
As I look in the mirror: I’m good enough, strong enough, and doggonit, people like me! Since this ordeal began, I have been reviewing my actions and behavior. Yes, it’s about him, the problem is with the one who is bullying. This brings about a question in my mind: do any therapists out there specialize in Realtor + personality disorders?
Avoid reacting and walk away
We didn’t call them (the lawyer or Gene Ayers) back. We neighbors discussed the calls and felt sad Gene Ayers chose to stoop so low. We were surprised. Did he really think such a tactic would scare us away? Really? Why not choose to communicate with us in a civil way? We may never get an answer to that. The experts say by not reacting you are able to deprive them of their sense of control.
Practice compassion.
The experts are indicating this person, Gene, was hurt, is hurt/damaged in some way, shape, or form. Maybe as a child. Maybe it doesn’t matter. All of us in this challenging world of ours have made mistakes. Exercising compassion, perhaps, will help our species evolve. Speaking for myself, believe it or not, I feel bad for him and hope he will one day heal. And that, is no joke.
Unfortunately the bullying continued with a harassment/intimidation letter from the same attorney Gene Ayers hired to call and harass us. The next article will focus on that incident.

Censorship is alive and well in Miller Beach, & the censor could be your nextdoor neighbor
Miller Beach residents are censoring who and what is discussed on the social media app Nextdoor by having their accounts disabled.
Back to the middle ages? Big Brother? Miller Beach residents upholding the values of dictatorships? Nazism?
What they don't know is their identity can be established. Shhhh...
08/21/2023
A number of neighbors encouraged me to post this, vacant lot I will call it, situation, on the social media app Nextdoor. I had reservations, due to the amount of negativity, ignorance, and sophistry witnessed on the Miller Beach dialog area in the past. All the same, I posted. Maybe it will help, I thought. Let's give it a chance.
It lasted a day and a half. The post was gaining momentum with many folks showing the desire to express themselves regarding this topic. Around 2pm on day two, I went to view the newer comments. My screen opened to an unfamiliar page that read: Your account has been disabled.
This is a screenshot of the partial nextdoor post before it was removed. This image only shows one point in time - there were many more comments right before my account was disabled. For now, click here to see the screenshot.
It is happening, it is bad, it is censorship
8/29/2023
This feels uncomfortable. This isn’t a good comparison. It’s not that bad!
If, for a moment, we can agree that Nazism is wrong, then I ask you to consider: How do ideas that are so very destructive to humanity get started? In small ways. Small ways that survive from falsehood and trickery.
We live in a difficult world with all types of obstacles. Many we expect, and then we go ahead and take care of them. Others though, perhaps a category of uniqueness when it comes to obstacles, we don’t expect, we are surprised, and sometimes we are shocked.
Imagine if you will, a small group of people appear at your home, wearing masks, all dressed the same, in black, knock on your door and declare that you are now forbidden to speak, interact, even show your face around a particular neighborhood group. In Miller we have a number of them: The Miller Garden Club, the Miller Citizens Corporation (MCC), the Miller Beach Arts & Creative District, the many religious organizations, the Miller Historical Society, and the list goes on. Well, this band of masked individuals shows up at your home and states that you may not interact with one of these groups anymore, under any conditions.
When you ask, “Why?” The response sounds like a computer generated statement: There was an error found on form 2735 E. What? I don’t know what that is. Can I see that form? They don't answer you.
This is called censorship.
I was recently censored on the social app/website nextdoor. Others in Miller Beach have also been censored.
Let’s look a definition of censorship, as defined by the ACLU:
Censorship, the suppression of words, images, or ideas that are “offensive,” happens whenever some people succeed in imposing their personal political or moral values on others. Censorship can be carried out by the government as well as private pressure groups. Censorship by the government is unconstitutional.
What is this nextdoor?
Here is one description: Nextdoor is a social app, a website, that helps you communicate with your neighbors. As an alternative to traditional forms of social media like facebook, nextdoor offers a way to foster relationships with your neighbors without having to knock on their doors. With the nextdoor app, you can start discussions with your neighbors to bring attention to important issues within your community.
The nextdoor social media website, mobile phone app, is also a handy tool. In the Miller Beach offering of nextdoor, I have seen neighbors post helpful information regarding traffic, power outages, utility issues, and safety issues. It is also a place where local events might be posted, like the farmer’s market, or an art show. If someone wants to ask a question, well the whole community can jump in and provide information. Sounds great, right? Here’s where the poorly lit area, the shadowy, dark area of nextdoor in Miller Beach comes into play. This is where ideas like censorship, dictatorship, secrecy, and suppression are performed; very much akin to former and current dictatorships.
To start with, regrettably, it looks like we have our own special, private pressure group in beautiful Miller Beach. They apparently exist, amongst other places, within the confines of the social media app nextdoor. Here’s how the pressure group works: If you express your feelings about an occurrence that you are unhappy with, and they don’t like the topic, not only will they pull your posting, they may disable your account. Hmmm. Really? Yes, really. And once your account is disabled, you cannot enable it. There is no one to call. Sending a message, after you figure out how to do it, may result in no response or a robot-like interest in the issue. You are out. Your only chance of gaining access again is making up a fake name, address, and phone number in attempts to create a new account. The phone number needs to be verified though, so if you don’t have several phone numbers (most of us only have one!) at your disposal, you are out of luck. The fake address is quite problematic too. If someone already lives there and is on nextdoor, well it isn’t going to work. From my research on nextdoor, people in this position often just give up and don’t use the service anymore. Others who are still on, may look for your post/recent issue, and may think you just left on your own, without knowing you were censored.
If you are thinking, who cares? Just don’t use it, use something else. Well, there is no comparable alternative. There are many Miller Beach residents who use this particular communication tool and thus, the pressure group takes control. A modern, freshly packaged version of Orwell’s Big Brother with its own Newspeak.
Okay, now I will make a comparison. It is a strong one, and relevant. Bare with me for a moment. During World War Two, the Nazis didn’t have enough secret police officers to find out who the nonconformists were, so they used citizens in neighborhoods. Some citizens passed on information about their neighbors, family, and friends to the Gestapo. This was called informing.
Informers had various motives including antisemitism, racism, a strong belief in Nazi ideology and governance, fear, personal gain, professional gain, and personal disagreements (e.g. informing the Gestapo that someone was a communist in response to a personal dislike or argument with that person). Most informers were aware of the consequences of their actions. We all know the atrocities that occurred under the Nazi regime. It is a disgrace of humanity, to say the least. It can be quite intriguing to research how such an abomination could even get started. Well, it got started with hate, pressure groups and censorship.
When a select few citizens of Miller Beach use certain tactics on nextdoor in order to suppress their personal dislikes, we have a much larger problem than a few legitimate posts being removed from an online forum.
Who are these folks? Any account holder can report something with the goal of flagging it for removal. If more than one person flags the same post, well the algorithm will move it up the ladder until it is removed. Hmmm, you mean if I contact a friend on nextdoor and ask them to flag something, we can gang up on an individual? Yes, indeed. You can bully others. Not only that, you can get away with it. The power of two against one.
There are also ‘neighborhood moderators.’ Did you know that? Individuals can volunteer or some may get a message asking if they are interested in being a moderator. There are two levels of moderators and they have more power than an individual account holder. They are just neighbors like you and me but have the power of censorship with virtually no accountability. That’s right, the Gestapo even knows how to get your account disabled. You are virtually wiped away from the nextdoor world. There is nothing you can do about it.
And, ladies and gentlemen, the Nazis have won. Sieg Heil! Anyone listening?, hello? ...
As long as it doesn't impact these ‘controllers’ or shall I say ‘informants’ well life goes on. No one can touch the Gestapo. This small circle gets to exercise a discrete form of dictatorship. Freedom of speech be damned.
How does censorship connect to the situation with Ayers Realtors and the alleged illegal sale of an empty lot? Quite simply, it appears some folks who associate with Gene Ayers, may, unfortunately, be the pressure group that disabled my account. Hey, we don’t like what you are saying! It doesn’t matter if Gene is working in an illegall manner, we are his friends, we blindly support him and we are going to silence you!
I’m not the first person in Miller who has been cut off on nextdoor.
Wait a minute! What? I am just doing the right thing. Yes, It is normal to want control, right? I want things to be this way. It is the right way. No, it’s not like the Nazis. How can you say that? I am just doing what I think is right. Yes, okay, subjectively. Okay, it may not be fair, but it is right. In my mind. Stop it, I am NOT a Nazi!
Our constitution, though not a perfect document, is also not a grouping of meaningless platitudes. It is predominantly a serious and important symbol of many good, perhaps many great attributes of this country (yes we have many not so great aspects, I know). The freedoms we do have, including the first amendment, freedom of speech, must remain untouchable, inviolable.
The website called nextdoor, private company or not, is no exception.
It has been a while since our last world war. It has been a while since the activism of the 1960s. We live busy lives and it is hard to keep up with all of our responsibilities. We are tired from working so hard. Much of society has become apathetic. And the dictators know this and use it as an opportunity to exercise control, right here in Miller Beach. Unless of course, we voice our concern, we band together, not for that small circle of informers (they have already banded together), but for freedom of speech, transparency, for equality. These topics are important. These topics are essential. We can never be too tired to care about them.

When the law is not upheld
08/10/2023
Miller Beach, a community in Northwest Indiana is considered a jewel to many who live here. There are trails, lagoons, wildlife, forested areas, not to mention the national parkland. Unfortunately, there are some flawed facets of this jewel that have been going under the radar for a very long time.
If it wasn't for the freedom of the press, this country of ours may have followed a path of the most corrupted countries in the world. The press has exposed, has put a spotlight on actions that were done 'in the dark,' or 'through the back door,' where some felt they could get away with it. It was and is often the press that acts as both the trigger and evidence for the justice system to perform its duties.
When someone or some entity hurts another, well that is wrong. When the entity hurts a community by going under that radar, at some point the unethical deeds will need to be stopped. This is the story of Ayers Realtors and how they have affected the very community that pays them.
This story begins with a local Realtor that has been selling/marketing a vacant lot as 'buildable,' when in fact it is not buildable due to zoning regulations. The minimum width for a lot to be buildable in the R1 zoning district is 59 feet, but the lot in question is only 40 feet wide. You cannot build a house here.
The lot is currently under contract/pending. It may close soon. It closed in January 2024.
Full disclosure: I am one of the neighbors. After speaking with others who live near here I witnessed their upset and disappointment at the Realtor who has shown little to no concern about the community, the land, or the animals. Is a small commission worth it in the end, I thought? The neighbors are quite upset about this situation and want to stop this before the closing occurs. You see, it will be much more complicated to deal with this situation after closing for all parties involved. We all want the lot to remain as is: forested. I have posted signs and have been passing out information packets to folks. More and more neighbors have stated they are willing to support this cause. Could this be the start of something much bigger?
Major point:
The Realtor has been selling/marketing this lot as ‘buildable’ when in fact it is not. This is an act of
misrepresentation and when this occurs, the Realtor/agent can be prosecuted for malpractice.
Our best guess is the buyer has either been misled by the Realtor or intends to muscle their way through the system to obtain a variance in order to build on this lot. Interestingly, the more residents in this area I speak with, the more I hear stories of ‘how easy it is to get a variance here.’ It should be very difficult, if not impossible. Zoning laws are important to uphold, for they do many things including to preserve the quality of the area. Allowing variances because the city needs money is simply reprehensible. If the city needs help, we will help the city, our city. To change important laws is analogous to a Judas kiss, being disloyal to those they have been entrusted to protect.
This same Realtor may have been doing this for many years, if not many decades. It needs to be stopped. The ‘selling out’ of Miller Beach/Gary Indiana, needs to end. Period. The lack of leadership, management and transparency is appalling. The beautiful beaches, forested areas, wildlife, ecosystems, let alone the quality of life for residents, are being destroyed for a few pennies.
City hall, and our appointed political leaders work for us. Let us never forget that. For when we do forget, their actions may go 'under the radar.'
Will you help us by getting the word out?
David Sconduto, Miller Beach resident
